Welcome to GOPAK (also referred to as “GOPAK CO.,” “Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of https://www.gopak.club/, our products, communications, and related services (collectively, the “Services”). By accessing the website, creating an account, subscribing, or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction and legally able to enter a binding agreement. Information you provide must be accurate and complete.

2. Account Registration

You are responsible for maintaining accurate account information, protecting your login credentials, and all activity under your account. We may suspend or terminate an account used unlawfully, fraudulently, or in violation of these Terms.

3. Product Information and Pricing

We aim to describe product colors, materials, composition, dimensions, fit, performance features, and prices accurately. Screen settings, lighting, dye lots, washing, and natural material variation may affect appearance. Measurements are approximate. Waterproof, water-resistant, sun-protection, support, cushioning, and traction statements apply only where stated on the product page and should be read with the sewn-in label or product instructions. Prices are shown in U.S. dollars unless stated otherwise. Taxes, shipping, and disclosed charges are calculated where applicable.

4. Orders and Payments

Orders are subject to acceptance, inventory, payment authorization, shipping restrictions, and fraud review. An automated order acknowledgment does not guarantee acceptance. We may correct errors or decline, limit, or cancel an order. If we cancel an item after collecting payment, we will issue the appropriate refund.

5. Shipping and Returns

Processing and delivery dates are estimates, not guarantees. Eligibility, condition standards, exclusions, and refund timing are governed by the Shipping & Returns page, which is incorporated into these Terms.

6. Intellectual Property

Website content, trademarks, text, graphics, product images, and software are owned by or licensed to GOPAK and protected by applicable law. You may use the website only for personal, noncommercial shopping purposes. Unauthorized copying, modification, distribution, scraping, or commercial use is prohibited.

7. Acceptable Use

Do not use the Services for unlawful or fraudulent activity, interfere with security or operation, upload malicious code, misuse promotions, impersonate another person, or attempt unauthorized access.

8. SMS and Voice Terms

If you separately opt in, you consent to receive recurring SMS/MMS marketing messages from GOPAK and, only where separately and clearly disclosed, marketing calls using automated technology or an artificial or prerecorded voice. Consent is voluntary and is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel marketing texts and HELP for help, or contact hello@gopak.club. We honor legally sufficient revocation requests made through reasonable methods. We may send one final confirmation of an opt-out where permitted. Carriers are not liable for delayed or undelivered messages. Mobile information and messaging opt-in data will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. Service providers may process it only to operate the messaging program.

9. Email Marketing

Marketing emails will identify the sender and provide a clear unsubscribe method. You may stop all marketing emails without charge. We process valid opt-out requests within the period required by applicable law. Necessary transactional, account, security, and order communications may continue.

10. Outdoor and Athletic Use

Outdoor and athletic activities involve inherent risk. Select apparel and footwear appropriate for your ability, fit, terrain, weather, and intended activity. Follow care, safety, and use instructions. Product imagery does not guarantee performance in every condition.

11. Disclaimer of Warranties

To the extent permitted by law, the website is provided “AS IS” and “AS AVAILABLE.” Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.

12. Limitation of Liability

To the maximum extent permitted by law, GOPAK will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the Services or products. This limitation does not apply where prohibited by law.
